On the evening of March 4, 2026, CHP received reports of a black BMW driving erratically at high speed southbound on US-101. Officers pulled Spears over near the Westlake Boulevard exit in Ventura County around 9:30 PM. She was the sole occupant and showed signs of impairment.

She was booked at approximately 3 AM and released around 6 AM. Blood was drawn at a hospital to determine BAC; chemical test results remain pending. An unknown substance was allegedly found in the vehicle.

Her rep called it an unfortunate incident that is completely inexcusable. On April 12, 2026, Spears voluntarily checked into a rehab facility. Her ex-husband Kevin Federline expressed support through his attorney. Spears is scheduled to appear in court on May 4, 2026.

In California DUI parlance, "wet" means the case involves alcohol. A "dry" DUI would be drugs only — VC 23152(e). Spears was charged under VC 23152(g), the combined alcohol-and-drug subsection, which is the most serious of the misdemeanor DUI categories because both impairment paths are charged at once.

Why it matters at arraignment and beyond: a wet charge keeps the standard alcohol-DUI penalty stack on the table (license suspension, fines, DUI school, ignition interlock) and opens the door to a "wet reckless" plea-down (VC 23103.5) — a common compromise that records alcohol involvement but reduces consequences. A drug-only DUI would instead negotiate around "dry reckless". The unknown substance reportedly found in the vehicle now sits squarely inside the charging theory.

DA already telegraphing the offer: Per the Ventura County DA's office, prosecutors will offer Spears a "wet reckless" — reserved for defendants who (1) have no DUI history, (2) had a low BAC, (3) caused no injury or crash, and (4) show "self-motivation to address underlying issues through rehabilitation or a drug and alcohol program." Spears appears to clear all four (Apr 12 voluntary rehab → Apr 30 completion covers #4 explicitly with a closed treatment arc), so the realistic outcome is probation + DUI school + fines rather than jail.
  • 01Charged with DUI after showing signs of impairment during field sobriety tests.
  • 02Reported driving erratically at high speed on US-101 before being pulled over.
  • 03Chemical test results still pending; an unknown substance reportedly found in vehicle.
  • 04Voluntarily entered rehab on April 12 - her rep says this is a step toward long overdue change.

The arrest comes five years after the end of Spears' controversial conservatorship. For advocates who fought for her freedom, the DUI raises painful questions about the support systems available post-conservatorship. Her voluntary entry into rehab has been broadly supported as a positive step.
